What Constitutes Rape?

The term rape (which is technically called Unlawful Sexual Penetration I or II in Oregon) encompasses several different types of situations. The most common include:

  • Sexual intercourse with someone under the age of consent (including statutory rape)
  • Sexual intercourse with someone who does not consent (including "date rape")
  • Sexual intercourse involving force or threats, which is a first-degree offense (a class A felony)
  • Sexual intercourse involving someone who is unconscious, mentally impaired or otherwise incapacitated and unable to consent (including the use of Rohypnol or "rufies")

What Are The Potential Penalties?

Most rape charges fall among the serious category of offenses known as Measure 11 crimes. What does this mean? If convicted, you will face a mandatory minimum prison sentence with no possibility of parole or early release. The prison sentence can be lengthy, especially for first-degree offenses.
